Patent Wars Update: Apple Files For Extension On Ban Against Samsung In Australia, Courts Award

According to Bloomberg, High Court Justice John Dyson Heydon extended the ban on Samsung’s controversial tablet until December 9, further cutting into valuable holiday shopping time.
“A stay for one week will cost Samsung, in effect, one week’s trade,” Heydon said, following a 90-minute hearing in Sydney. The extension will hurt Samsung “but not to extend the status quo is likely [emphasis added] to be injurious to Apple,” he said.
Samsung had big plans to begin importing the Galaxy Tab 10.1 this weekend to take advantage of pre-Christmas shopping. The company will likely give up and walk away from Australia all-together if it can’t get the tablet on shelves before Christmas.
Apple’s lawyers have no sympathy for their rival. Lawyer Stephen Burley told the judge yesterday that Samsung’s push for a big release confirms the need for a stay. “Even a short release of the product can cause irreversible harm to Apple and Samsung won’t be able to compensate Apple for those damages,” he said.
The clock is ticking for Samsung. If they can’t get their tablet on the shelves soon, they’ve lost the battle, no matter what the High Courts decide.
