Motorola recently won a patent case against Apple, Inc. in Germany, which means that the iPhone and iPad may be blocked from sales in the country if the company cannot secure a stay until an appeal can be heard.
After the country’s recent ban on the sale of Samsung’s Galaxy Tab 10.1, the tablet market may start to shrink for German consumers.
According to SlashGear, German courts ruled that Apple’s cellular-enabled devices infringed on European Patent 1010336, which details a “method for performing a countdown function during a mobile-originated transfer for a packet radio system,” and is” deemed an essential component of the GPRS data standard.”
A ban on the sale of Apple mobile devices is not necessarily imminent. Motorola would have to pay an approximately $1.56 million bond if they were to pursue an injunction. The bond is designed to cover Apple’s losses if the patent case were to be subsequently overturned while an injunction was imposed. Apple would likely request a stay on the injunction since the original iPhone, iPhone 3G, iPhone 3GS, iPhone 4, iPad WiFi + 3G and iPad 2 WiFi + 3G are all named in Motorola’s case.
SlashGear has posted an update to their story to include a statement from Scott Offer, senior vice president and general counsel of Motorola Mobility.

“We are pleased with the court’s ruling. Today’s decision validates Motorola Mobility’s efforts to enforce its patents against Apple’s infringement,” he writes. “We will continue to take all necessary steps to protect our intellectual property, as the Company’s patent portfolio and licensing agreements with companies both in the U.S. and around the world are critical to our business.” Scott also adds, “We have been negotiating with Apple and offering them reasonable licensing terms and conditions since 2007, and will continue our efforts to resolve our global patent dispute as soon as practicable.”
