Samsung To Apple: Lawyers Demand To See The iPad 3!

thisismynext cites that Samsung has recently filed a motion within their ongoing legal battle with one another to hand over the iPad 3 as well as iPhone 5 commercial versions to avoid future infringement.
They are claiming that it is part of the discovery process within the confines of the legal feud that began with Apple originally filing the lawsuit over complaints that Samsung’s Galaxy line was eerily similar to their iPhone and iPad devices.
Each party would only be allowing lawyers to view the top secret iPad 3 & iPhone 5 plans. Think about how out of control it could get if the competitions engineers were allowed as well, giving them an immediate one-up to try and re-engineer their products before their release.

To us this sounds like a rebuttal against Apple after Apple’s lawyers were granted a motion to view Samsung’s upcoming devices that were going to hit the market. The difference here however is that these devices were already made public and had been previously demoed.A worthy try by Samsung, but likely not grounds for discovery and full disclosure of a highly classified iPad 3 prototype. Apple who has initiated the suit had legitimate grounds since their products are being infringed upon according to design, look and feel violations. We likely won’t see anything come out of this request by Samsung.
The bigger kicker here is that Samsung is going after Apple’s devices that have yet to even be officially announced. Samsung has come to support this motion by claiming that internet reports suggest that Apple will be releasing the next version of the iPhone in September and the iPad 3 later this year.
While these devices are most certainly in the development stages, Samsung is basing their claim on internet reports and current trending iPhone and iPad 3 rumors?
